LIMITATION OF LIABILITY AND DISCLAIMER

IN ALL CIRCUMSTANCES, YOU AGREE THAT DMD Computer Service, ITS EMPLOYEES, CONSULTANTS, AGENTS, OR OTHER REPRESENTATIVES ("SERVICE PROVIDER") MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD AND/OR SERVICES RENDERED. SERVICE PROVIDER SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCE FOR CLAIMS AGAINST US FOR DAMAGES AGAINST THE CUSTOMER. FURTHERMORE, SERVICE PROVIDER SHALL NOT BE LIABLE FOR LOSS, OR EXPENSE OF ANY KIND ARISING OUT OF OR RESULTING FROM MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS OR INCOME, LOSS OF GOODWILL, WORK STOPPAGE, LOSS OF DATA, AND/OR SUBSEQUENT DAMAGE TO ANY HARDWARE DUE TO HARDWARE FAILURE, SOFTWARE FAILURE, OR VIRUSES. SERVICE PROVIDER IS NOT RESPONSIBLE FOR ANY OF THE FOREGOING OBLIGATIONS, AND CUSTOMER SHALL HAVE NO RIGHT OF RECOURSE AGAINST SERVICE PROVIDER FOR ANY SUCH OBLIGATIONS. IN NO EVENT, SHALL DMD Computer Service OR ANY OF ITS SERVICE PROVIDERS BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES REGARDLESS OF WHETHER DMD Computer Service OR ANY OF ITS SERVICE PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ALL OTHER PRODUCTS AND SERVICES AVAILABLE FOR ORDER THROUGH SERVICE PROVIDER BESIDES THE SOFTWARE (THE "OTHER PRODUCTS") ARE DISTRIBUTED ON BEHALF OF THIRD-PARTY SUPPLIERS ("SUPPLIERS"), UNLESS OTHERWISE INDICATED. EXCEPT FOR THE DMD Computer Service RETURN POLICY, ALL OF YOUR RIGHTS AND REMEDIES WITH RESPECT TO YOUR ORDER, PURCHASE, POSSESSION, AND USE OF THE OTHER PRODUCTS AND ALL MAINTENANCE, UPDATE, WARRANTY, LIABILITY, AND ANY OTHER OBLIGATIONS RELATED TO THE OTHER PRODUCTS, IF ANY, SHALL BE GOVERNED BY THE APPLICABLE POLICIES AND PROCEDURES OF THE SUPPLIERS.

BY SIGNING THE INVOICE OR QUOTE YOU AGREE TO PAY SERVICE PROVIDER IN FULL FOR PRODUCTS AND OR SERVICES RENDERED AFTER JOB COMPLETION. FAILURE TO PAY WILL RESULT IN LEGAL ACTION IN WHICH YOU AGREE TO PAY FOR ALL LEGAL COSTS INCURRED BY DMD Computer Service TO OBTAIN PAYMENT. ANY CHECKS NOT HONORED UPON PRESENTATION TO THE BANK WILL INCUR A $35 BAD CHECK FEE, WHICH WILL BE BILLED TO YOU

DMD Computer Service PRIVACY POLICY, USER AGREEMENT CHANGES

IF WE DECIDE TO CHANGE OUR PRIVACY POLICY AND/OR USER AGREEMENT, WE WILL POST THESE CHANGES ON http://www.dmdcomputerservice.webs.com/ SO THAT YOU WILL ALWAYS KNOW WHAT INFORMATION WE GATHER, HOW WE MIGHT USE THAT INFORMATION, AND WHETHER WE WILL DISCLOSE IT TO ANYONE. THIS AGREEMENT IS SUBJECT TO CHANGE WITHOUT NOTICE.

WARRANTY


ALL NEW SOFTWARE OR HARDWARE COMES WITH A WARRANTY FROM THE MANUFACTURER AND NOT SERVICE PROVIDER. ANY ISSUES WITH SOFTWARE SHOULD BE TAKEN UP WITH THE MANUFACTURER OF THAT SOFTWARE. ALL HARDWARE SOLD BY SERVICE PROVIDER COMES WITH A 90 DAY WARRANTY FOR PARTS ONLY, LABOR IS EXTRA UNLESS OTHERWISE NOTED. ANY SOFTWARE REPAIRS, VIRUS REMOVALS, INSTALLATION OF SOFTWARE OR ANY OTHER SOFTWARE RELATED SERVICE IS WARRANTED FOR 15 DAYS UNLESS OTHERWISE NOTED.

 ANY SERVICE OFFERED BY SERVICE PROVIDER IS GUARANTEED TO WORK BEFORE WE LEAVE. IT IS THE CUSTOMERS RESPONSIBILITY TO VERIFY ALL WORK BEFORE SIGNING THE FINAL INVOICE AND GIVING PAYMENT. AFTER PAYMENT IS RECEIVED AND INVOICED SIGNED YOU AGREE THAT WORK WAS DONE TO YOUR SATISFACTION.
